Agreement to Terms

By accessing or using MXBuildium's property management platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Use License

Permission is granted to temporarily access the platform for personal or commercial property management use. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the platform materials
  • Use the materials for any commercial purpose without authorization
  • Attempt to reverse engineer any software contained on the platform
  • Remove any copyright or proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

User Accounts

Account Creation

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the platform in any way that violates applicable laws or regulations
  • Engage in any conduct that restricts or inhibits anyone's use of the platform
  • Transmit any advertising or promotional material without our prior written consent
  • Impersonate or attempt to impersonate the Company, an employee, another user, or any other person
  • Engage in any automated use of the system
  • Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material

Subscription and Payment Terms

Billing

Some aspects of the platform are provided on a subscription basis. You will be billed in advance on a recurring and periodic basis (such as monthly or annually). Billing cycles are set at the time of subscription purchase.

Refunds

Certain refund requests may be considered on a case-by-case basis and granted at the sole discretion of MXBuildium. Please contact our support team for refund requests.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Limitation of Liability

In no event shall MXBuildium or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the platform, even if MXBuildium or an authorized representative has been notified of the possibility of such damage.

Intellectual Property

The platform and its original content, features, and functionality are and will remain the exclusive property of MXBuildium and its licensors. The platform is protected by copyright, trademark, and other laws.

Termination

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
